$3.5 Million Confidential Settlement– Pedestrian v. Driver
FACTS: In September 2019, defendant driver took an illegal right turn at Golden Gate and Leavenworth streets in San Francisco. He struck my client, then age 11, who was a pedestrian lawfully in the crosswalk.
The driver was an employee of a software company. He was charged with a felony, operating a motor vehicle under the influence of drugs (marijuana edibles) and causing injury.
The boy was dragged under the vehicle and suffered left-sided facial degloving, which has left significant scarring.
The driver’s employer argued that he was not driving within the course and scope of his employment. The company’s insurance carrier denied coverage and also filed a declaratory relief action in Federal Court.
Chuck Geerhart obtained all necessary records, filed a lawsuit, took depositions, battled the carrier on the coverage issues, and got the court to order trial preference for the minor plaintiff. He also had a plastic surgeon expert evaluate the child.
RESULT: The case was settled one month before trial for $3.5 million. This was approved by the court.
